Terms of Service for Business Growth Marketers^™

These Terms of Service constitute a legally binding agreement between you and Business Growth Marketers ("we", "us", "our"), operating at businessgrowthmarketers.com. By accessing our website, requesting a complimentary Business Growth And Profit Plan, booking a consultation via http://book.primeallow.com, or purchasing any service, you agree to these terms.

If you do not agree, do not use our site or services. Honest growth starts with clear expectations.

2. Our Services

Business Growth Marketers is an AI-forward digital marketing agency serving small and mid-sized businesses nationwide. Our services are designed to be affordable and compounding. Proof of performance matters more than promises.

What we do

• Search growth: SEO optimized for traditional Google, AI search (AEO), generative engine optimization (GEO), and answer engine visibility (VEO).
• Lead systems: CRM integration, AI chat and voice, form capture, nurture automation, and attribution.
• Advertising: Affordable paid search, social, and retargeting with real-time ROI reporting.
• Content and reputation: Website content, video that ranks, business listings, and review acceleration.
• Compliance: ADA / accessibility audits and remediation with proper H3 alt titles, link titles, and semantic heading proof.
• Funding and automation: Guidance through our GrowBotik network including BOS, traffic, and funding education.

Service scope, deliverables, and timelines for paid engagements are described in your proposal or order form. Where a conflict exists, your signed proposal controls.

3. Client Responsibilities

Real growth is a partnership. You agree to:

• Provide accurate business information, access to existing domains, hosting, analytics, ad accounts, and CRM needed to perform the work.
• Respond to requests for content, approvals, and brand assets within 5 business days to avoid project delays.
• Ensure any content you provide is owned by you or properly licensed and does not violate third-party rights.
• Maintain legal compliance for your products, pricing, claims, and industry disclosures. We advise, we do not act as your legal counsel.
• Never use our services to send spam, deceptive claims, or violate Google, Meta, or other platform policies.

Warning: Accounts delayed 14+ days due to missing client assets may require rescheduling and may affect launch dates. Because coordination is the underrated growth multiplier.

5. Payments and Affordable Pricing

Affordable does not mean cheap work. It means pricing that a real SMB can sustain for 12 months so growth can compound. Fixed fee, retainer, or performance hybrid pricing will be stated in your proposal.

• Invoices are due as stated in the proposal, typically monthly in advance for retainers.
• Late payments may pause service delivery after 5-day notice.
• Ad media spend is separate and paid directly to platforms unless otherwise agreed.
• No long-term lock-in beyond what your proposal states. Cancel per notice terms in your agreement. Because nobody should be trapped by fine print.

Refunds: Due to the custom strategy and labor nature of marketing services, fees for work performed are non-refundable. Pre-paid but unperformed future months may be refunded at our discretion minus committed costs.

6. Intellectual Property

Pre-existing materials remain owned by their owner. Custom copy, designs, and code we create specifically for you become yours upon full payment. Our underlying frameworks, Business Growth Engine prompts, checklists, SOPs, and the ProfitQuests methodology remain our intellectual property and are licensed for your use as long as you remain a client.

You grant us permission to showcase anonymized results or, with your written approval, case studies featuring your brand as proof that affordable growth actually works.

7. Confidentiality

Each party agrees to keep confidential business information received during service delivery. We do not sell your data. Our team and sub-processors are bound by confidentiality and operate on a need-to-know basis. See our Privacy Policy for how we handle personal data.

We provide services with professional care and will remediate any deliverable that fails to materially meet the agreed scope if reported within 14 days. EXCEPT FOR THAT REMEDIATION COMMITMENT, SERVICES ARE PROVIDED "AS IS" AND WE DISCLAIM ALL WARRANTIES. Marketing performance depends on many factors outside our control including offer quality, seasonality, platform algorithm changes, and sales execution.

SEO, AEO, GEO, and VEO improvements cannot be guaranteed to specific rankings or traffic levels. We provide honest projections, not guaranteed outcomes. Game-changer results happen when you implement consistently.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR LOST PROFITS DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY.

Some states do not allow limitation of incidental or consequential damages, so this may not apply to you.

10. Term, Termination, and Governing Law

• Term ends as stated in your proposal. Either party may terminate for material breach not cured within 10 days after written notice.
• Upon termination, you remain responsible for fees through termination date and for media committed.
• Upon termination, we will return your assets and provide transition assistance up to 7 days at our standard hourly rate.
• These Terms are governed by the laws of the State where Business Growth Marketers is primarily operated, without regard to conflict of law principles.
